This here present information statement is issued to provide details regarding the process of your personal data, as per the Law on the Protection of Personal Data (“Law”) shared with Y Turizm Ticaret Ltd. Şti. (Petros Hotel) bearing the quality of data supervisor.

Brief on the Law on the Protection of personal Data

Our company and our workplace Y Turizm Ticaret Ltd. Şti. (Petros Hotel), is taking top level security measures to collect, to store and to share your personal data and to ensure their confidentiality.

Our aim; is to inform you with full transparency as per the article number 10 of the Law with number 6698 on “Protection of Personal Data” and as per your complacency, about how your personal data is collected, why it is processed, with who they are shared, judicial reasons and your rights.

a) Data Supervisor   

As per the law with number 6698 on “Protection of Personal Data” (“Law with number 6698”) your personal data; shall be collected and processes by Y Turizm Ticaret Ltd. Şti. (Petros Hotel) being the data supervisor.

b) Which personal data shall be collected

Personal data which we shall collect may contain the followings:

• Identity details (First and family name, gender, title, place and date of birth, nationality; other identity details figuring on your passport, visa or other identity documents issued by the state);
• Communication details (Home and work address, phone number and e-mail address, other communication details of yours which we can obtain from our third party work partners such as travel agencies or similar suppliers)
• Your preferences and interests (Information and observations concerning the hotels you have stayed in, check-in and check-out dates, purchased products and services, special requests, service preferences, also guests’ accommodation services including the type of room, preferred floor, newspapers/periodicals, sport and cultural interests, facilities, holiday preferences, requested services, age of children or other aspects of the services that you have used)
• Phone numbers you have dialed, sent/received faxes or phone messages received when connected to the phone services we have provided to our guests during their accommodation in our hotel;
• Credit card numbers and ATM card numbers
• If you are an employee, vendor of a corporate account or another kind of partner, employee data or other related data (i.e. travel agency or meeting and event organizer)
• Social media account data or user identity
• In case you provide personal data of others to us or to our service suppliers concerning the services, (i.e. making a reservation for someone else), you do agree that you are entitled to do so and that you give your consent that these data shall be used as per this briefing.

c) When your personal data shall be collected

Personal data can be collected for various occasions including below ones:

• Hotel activities:
  • Room reservations
  • Check-in and payment
  • Eating/Drinking at the bar or restaurant of the hotel during your accommodation
  • Requests, complaints and/or disagreements
• Participating to marketing programs or events:
  • Registering to loyalty programs
  • Participating to client surveys (i.e. guest satisfaction survey)
  • To subscribe for bulletins to receive offers and promotions sent by e-mails.
• Conveying information from third parties:
  • Tour operators, travel agencies, reservation systems and others
• Internet activities:
  • Connection to the websites of Petros Hotel (IP addresses, identification details)
  • Online forms (online reservation, surveys, Petros Hotel pages on social network)

ç) The purpose of processing personal data

It can collect personal data from parties such as potential clients, guests, candidates of employees, employees, partners, travel agencies, tour operators and suppliers for aforesaid categories.

Collected personal data of yours shall be processed under the conditions and aims provided by the articles 5 and 6 of the code with number 6698.

– to provide you with the products and services of Petros Hotel, to fulfill our liabilities for you, to issue the registries and documents, to respect the liabilities concerning data saving, reporting, informing, tax and other liabilities requested by national and international legislations,

– to manage your hotel accommodations: to track the services you have used (phone, bar, paid TV, etc.), to manage room access, internal management of the lists concerning the guests who have not behaved during their stay in our hotel, (aggressive and antisocial behaviors, not respecting hotel agreement, not respecting security settings, incidents of robbery, damage and vandalism).

– To determine the existence of Petros Hotel services,

– Advertisements, campaigns, advantages and other favors specific to you for sales and marketing activities to increase the quality of services and products,

– To get in touch with you for data processing requirements, system structure, requirements of collected data process supporting services, to inform you concerning these services and products,

– To arrange room reservations for  Petros Hotel,

– Traffic measuring for sales and marketing activities, cross check of your data collected during the reservation or accommodations enabling us to make you customized offers, statistical analyses, carrying out segmentation / profiling and CRM studies,

– Measuring and increasing client satisfaction, complaint management, to gather your opinions and recommendations concerning new services and products, to receive your problem-error notifications, to take into consideration the right of objection, to inform you concerning other products and services, complaints and requests,

– To use special phone services to call the clients staying in Petros Hotel,  in case serious incidents (natural disasters, terrorist attacks, etc.) affecting the hotel in subject occur

– To have your orders, to execute the payments, to forward products by a logistic cooperation with 3^rd parties, to recommend products and services which may interest you, online behavioral advertising and marketing, client portfolio management, measuring and developing service quality, communication, optimization, audit, risk management and control, promotion, analysis, determining interest fields, scoring, profiling, marketing, sales, advertising, communication

-offer of comparative product and/or service, modeling, works for existing ornew products and/or their development, using all and any product and service that are going to be offered to your side under the scope of codes and legislations regulating the works described on the articles of incorporation of Petros Hotel, making subject of your disclosure of personal data to Petros Hotel

– Fulfilling the liabilities of data saving, reporting, informing provided by public authorities and the requirements of the agreements and to execute the legal liabilities to which Petros Hotel is subject with regard to provide these services,

– In line with the aim of determining and applying Petros Hotel’s commercial and business strategies; managing finance operations, communication, market research and social responsibility activities, purchase operations (demand, offer, assessment, order, budgeting, agreement), internal system and application management operations and legal operations to be carried out by Petros Hotel

– To review, to assess and to reply the demands from official authorities or from you,

c) To whom processed personal data can be transferred and for which purpose

Your collected personal data; to be restricted by carrying out aforesaid purposes, shall be transferred within the scope of personal data processing conditions and purposes provided by articles 8 and 9 of the Code with number 6698, to;

– the hotels or restaurants operating within the structure of Y Turizm Tciaret Ltd. Şti. are affiliated, as well as to subsidiaries, associated companies, affiliates, partners, shareholders,

– your identity, communication and required other details  to inland or abroad hotels or restaurants to which you have made a reservation inland or abroad, using Petros Hotel web site, call center or other channels, in order to convey your demands and requests,

– To relating establishments and institutions under the frame of Tourism Promotion Law, Travel Agencies and Travel Agency Union Law, Regulation on the Documentation and Qualification of Tourism Facilities,

– To individuals and institutions permitted by the provisions of Tax Procedure Law, Social Security Institution legislation, Court of Accounts, Law on Preventing Money Laundering of Crime Proceeds, Law on Preventing Money Laundering, Turkish Trade Code, Debts Code and other legislation,

– To public institutions and establishments permitted by the code, administrative authorities and legal authorities,

– To companies and affiliates abroad,

– to real or legal persons, program partner establishments and institutions, to institutions with which we have an agreement for sending the  mails to our clients, to cargo companies delivering you the products you have ordered, which we are using their services to carry out product/service comparison, analysis, assessment, advertising and the purposes mentioned here above

ç) Method and Legal Motive of Collecting Personal Data

Your personal data is collected by Petros Hotel, under the frame of legal legislation for aforesaid purposes, to be directly related to the issuance or execution of the agreement and as it is obligatory to fulfill our legal liabilities and under other exemptions provided by the article 5 of the Code.

Being below primary channels with other ones which shall be established / created;

• Via online service such as our web site and contracted web sites: When you make a reservation or when you purchase a product or a service from us by other means, when you reach us via online messaging services, when you inform us about your special requests or preferences, when you are registered for a bulletin, a survey, a competition or a promotion.
• Via all and any kind of physical media of verbal and written information sharing and customer services: We can collect personal data of yours online, for example when you visit one of our facilities, when you make a request to use our services, when you inform us about your preferences, when you make a reservation on the phone or when you reach customer services.
• Via other resources such as our business partners, suppliers and travel agencies: We maycollectyour personal data from other resources such as joint marketing partners and third parties. These can comprise the information collected from your travel agency, airline company, your credit card and other partners.
• Via our social media accounts

d) The rights of the personal data owner, provided by article 11 of the Code with number 6698

Yaşmak Comfort Hotel shall execute within the most convenient time and latest within thirty days, based on the nature of the request, your requests made by your side as the owners of personal data, if they shall be made by below methods.

The fee to be collected by our company, in case the reply is requested to be delivered on a CD or on a Flash disk, cannot exceed the cost of the media to register the reply on.

Under the scope of the above, the owners of the personal data; have the rights of  

• Being informed whether personal data is processed or not,
• Asking information concerning the personal data process if it is processed,
• Learning what is the aim of processing personal data and whether they are used in conformity with the aim,
• Knowing about the third persons inland or abroad to whom the personal data is transferred,
• Requesting, in case the data is processed erroneously or incomplete, corrections and to inform the third parties to whom these data are transferred, about the procedure that is executed,
• Although it is processed under the Law with number 6698 and its relating dispositions, in case the reasons requiring the process do not exist anymore, requesting the personal data to be deleted or to be destroyed and to inform third persons about the procedure that is executed,
• Objecting to the result arising against the person him/herself from exclusive automatic analysis of processed data,
• In case personal data is damaged due to being processed illegally, requesting a compensation for occurred damage.

You may send your request of using your rights mentioned here above, in compliance with the Communiqué pertaining the Application Procedure and Principles to the Data Supervisor, dated 10.03.2018, numbered 30356 and the 1^st paragraph of the article 13 of the Code with number 6698, in Turkish and in written or by using registered electronic mail (KEP) address, secured electronic signature, mobile signature or an e-mail address registered to our system and which is notified to Petros Hotel previously.

Petros Hotel preserves the right to confirm your identity before replying you.

Your application must include;

1. Your first and family name and your signature if your application is made in written,
2. Citizenship number of Republic of Turkey for Turkish citizens; nationality and passport number or identity number, if any, for foreigners,
3. Address for notification of your residing place or your work address,
4. E-mail address, if any, or phone number and fax number for notification,

d) Subject of request, and information and documents regarding the subject must be included, if any.

You may send your written applications by registered and reply paid letter, enclosing necessary documents, to the address of our company at Hüseyinağa Mahallesi, Balo Sokak, No:30 Beyoğlu-Istanbul-Turkey.

Based on the nature of your request, the information and documents must be supplied accurately and incompletely. In case required information and documents are not provided accurately, researches to be performed by Petros Hotel based on your request may encounter obstacles preventing them to be complete and well qualified. In such a case, Petros Hotel declares to preserve its legal rights. Accordingly, your application must be sent containing all appropriate information and documents based on the nature of your request. Your request shall be assessed by Petros Hotel and shall be concluded within latest 30 (thirty) days as provided by the Law. Although as a principle no fee would be charged for requests, Petros Hotel preserves its right to request a fee based on the tariff of the Council for Protecting Personal Data.

REGARDING CLOSED CIRCUIT CAMERA REGISTRATION SYSTEMS

This here present information statement is issued to provide details regarding the procedures and principles pertaining the process of the personal data collected by closed circuit camera registration systems at the facilities of Y Turizm Ticaret Ltd. Şti. – Petros Hotel, as per the Law on the Protection of Personal Data (“Law”) with number 6698, to inform data owners.

1. Aim of processing personal data

Collected personal data, under the scope of the personal data processing conditions and purposes provided by the articles 5 and 6 of the Law, is processed to ensure judicial, technical and commercial-labor safety of the individuals who are in a business relation with the Branch and for the security purposes of the locations connected to the branch.

• Parties to whom the personal data can be transferred and the purpose of the transfer

Collected personal data, under the scope of the personal data processing conditions and purposes provided by the articles 8 and 9 of the Law, can be shared with legally authorized institutions and establishments to ensure judicial, technical and commercial-labor safety of the individuals who are in a business relation with the Branch and for the security purposes of the locations connected to the branch.

3. Method and Legal Motive of Collecting Personal Data

Personal data is collected by via closed circuit camera systems installed within the facilities. Personal data collected based on the above mentioned legal reasons can be processed and transferred, under the frame of the conditions and purposes of processing personal data, provided by the articles 5 and 6 of the Code with number 6698, and for the purposes indicated by articles 1 and 2 of this here present Information Statement.

4. Rights of data owners and use of these rights with regard the article 11 of the Code, data owners have the rights,

• To learn whether personal data is processed or not,
  • Request information if personal data is processed,
  • Learning what is the aim of processing personal data and whether they are used in conformity with the aim,
  • Knowing about the third persons inland or abroad to whom the personal data is transferred,
  • Requesting, in case the data is processed erroneously or incomplete, corrections and to inform the third parties to whom these data are transferred, about the procedure that is executed,
  • Although it is processed as per the dispositions of the Law and other relating dispositions, in case the reasons requiring the process do not exist anymore, requesting the personal data to be deleted or to be destroyed and to inform third persons about the procedure that is executed,
  • Objecting to the result arising against the person him/herself from exclusive automatic analysis of processed data,
  • In case personal data is damaged due to being processed illegally, requesting a compensation for occurred damage.

Aforesaid rights, shall be concluded within 30 (thirty) days, if they are sent by data owners in conformity with the methods indicated on the address https://www.petroshotel.com  under Y Turizm Ticaret Ltd. Although as a principle no fee would be charged for requests, the right to request a fee based on the tariff of the Council for Protecting Personal Data is preserved.
